Frequently Asked Questions

What is Estate Planning?

Your estate is made up of everything you own. Estate planning puts together a clear plan to protect your assets, your loved ones and to minimise tax.

It ensures your exact wishes are implemented regarding how you would like your estate to be managed and distributed on your death, or managed during your life should you become incapacitated.

This can involve both death planning and lifetime planning.

Yes! Our initial consultations are free and you are under no obligation to use our services.

Not necessarily. For some, a more traditional basic Will could be more appropriate. At the free initial consultation we will assess your circumstance and objectives. We then present options and costs to enable you to make an informed decision. We never put you under any pressure.

However, a simple Will will not offer protection against:

  • Long term to care fees;

  • Marriage after death;

  • Generational IHT;

  • Divorce of beneficiaries;

  • Insolvency of beneficiaries;

  • Beneficiaries losing means tested benefits.

If you want protection from any of the above, Wills with Trusts are usually more appropriate.

The use of Trusts is important for securing the future of mentally disabled children and could offer tax advantages.

Otherwise paying an inheritance direct could mean existing benefits and support is lost and leave the money vulnerable to gold-diggers or them to exploitation.

Trusts and trustees can ensure their best interests are always met in the most tax efficient manner possible.

On the contrary, most find our Trust products to be very reasonably priced and affordable, particularly when considering the protection they create, the amounts of extra money that can be kept withing the family and the peace of mind they create.

You can draft your own LPAs and register them yourself with the Office of the Public Guardian (“OPG”).

However, if you make a mistake you may be charged the registration fees again and delay the registration process. 10,000s are rejected by the OPG every year.

Mistakes on the LPAs, particularly with instructions or preferences can cause problems using the LPAs, or even mean they cannot be use as you intended.

We give full advice on what is most appropriate for you, draft the LPAs (including any instruction or preference clauses) and guarantee their registration.

We also give free advice and support after regsitration to you and your attorneys.

If you are within the Reading area, we can usually come to you. If you are a greater distance we can still come by special appointment or conduct things remotely by telephone, email, post and/or videocalls.
